View Full Version : Legal to wheel on NYS land?

Just wanted tp put a shout out and see what anybody knows about this. I have a friend whose family farm gave NY a right-of-way to pull logs off of the state land behind their farm. The log trails up there are great but I am not sure about NY and ORVs. I know there was talk about NY turning this area into an ATV park when they were finished. It is a great area and would be great to wheel if anybody knows the specifics with NY. I have been up checking out the area because our fire/EMS squad is planning on using the Zuk to acess the area if we need to do any rescue work. We pulled a 72 yr old hunter out from under his quad last year the sunday before rifle season opened up.....would have been nice to have it then.

As far as nys laws if your buddies family owns the land they can grant you permission to use it. if not and you know who thw owner is I can help you out with getting permission to use it. We have local club that carry INS and have people who negotiate to get access to such land.

There are also a few other farms in the area that I may be able to get permission to access. Alot of them around here have been logged in the past so the "trails" are still somewhat visible.

Oh boy am I confused. If you cannot get permission from the landowner than you have no right to be on there. I would advise against it. Trespassing and wheeling on land without the owners permission makes it hard for clubs and association that are trying to gain access legally to private land. Trespassing is illegal and gives us all a bad name. be smart and go through the propper channels most landowners would be glad to recieve a check for use of there land.

I have no problem with the farm...their son was in the passenger seat this weekend. What I am wondering about is does NY allow ORVs on their land? The farm is no problem.....I am just questioning if I could bring a group up to the area and travel the log roads that are cut on the NY property.

That is what I am asking about......I know it is legal for ATVs ..... I am wondering about ORVs. I have been in there scoutingthe trails for our fire dept but wanted to know what the state laws are on it if I was to bring a group to the area. This is a piece of state land that is open for hunting and such.

i cant answer your question but i know what your saying. 90% of the game lands in PA are off limits to ORV's

What kevin is trying to ask is if NY is the same way. do they allow access to games lands with an ORV or is it offlimits and only allowed access via foot or horseback.

i found those doing just a quick internet search. i guess it would make sense to contact the DEC and find out if these logging roads count as state roads now. cause according to what i found (again read PA resident does quick internet search) there are designated areas for ATV access which im assuming would also mean ORV but you have to stay on state roads. if those logging trails are considered a man made road then it would make sense that you could use them if that area of the state forrest is ok for ATV/ORV access

as far as atv's on hunting grounds I have yet to see a NY state piece of land that you are even alowed to hunt on every thing down here is private land for hunting and it is up to owner of the land. As far as being able to drive on that property I know that in NY there is no land owned by the state that is left open to roam with any motorized vehicles. there are some snowmobile trial up north that are state owned but the are leased to the snow mobile clubs. Those guys have permission. I am in the middle of a new club that is forming right now to help fight for land use in NY state. we used to have land that you could roam on but it has allbeen taken away. If you have a loction of the land I will pass it on to the land use director and have him look into it and see if it is acuireable or if permission has be set already. (do not post it on the boards call my office or email it to me) I don't want someone to go and trash it before I can get you guys permission to use it.

Old thread, but since I'm in NY and use state lands I figured I'd chime in...

Most of the wooded areas designated with "State Land" signs have some sort of access road (hunting, fire patrol, whatever). Since these are usually gravel/dirt and somewhat maintained (meaning more than 2 ruts through a field) I assume you can drive a truck/jeep on them. Any place they don't want you to go is either labeled with a "no motorized vehicles allowed" sign, and massive dirt pile (or 2 or 3) to block the trail, or some other means of blocking access setup across the trail. Those are usually side trails off the main access one, but that still leaves the main/better maintained one to use. I have never seen anything that differentiated between trucks and ATVs about access, unless you count trail markers for snowmobile trails. I've even passed a park ranger on one such trail and he said it was ok to be there as long as I obeyed the signs.

All of the New England states, including New York, make distinct differences between ATV/OHMs and registered, passenger vehicles. Reg/Ins'd passenger vehicles are only allowed on state or town designated roads. A temporary logging road, on state land, would not be considered a legal road to drive a Jeep, truck, etc, on.
If you are speaking of anything in the Adirondack Park, then its even less likely you will find anything available that will challenge even a stock 4x4... That is legal and open to use.

Old town roads are an entirely different animal.. Those are roads that are still on the books (in order to get Federal Hwy $$) but have not rec'd any maintanance in many years... and.. they are TOWN jurisdiction, not the state.

As for signs... lack of signs, unfortunately, does not make an area legal. Most of the state lands in New England are not properly signed due to lack of funding. The popular state parks will often have plenty of signs where as the less traveled, undeveloped state forests will often have little or no signage but may still be off limits... The only way to be fully sure is to conatct the ranger/land manager for that particular state area.
